1. Eligibility
The 7taps Contest is open to anyone who signs up at https://www.7taps.com/contest. This contest is subject to federal, state, and local laws and regulations and is void where prohibited by law. 7taps employees, its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees, are ineligible to participate in the 7taps Contest. Participants residing in the US are also eligible to receive a pair of 7taps socks for taking part in the Contest.
2. Sponsorship.
The sponsor is 7taps OpCo LLC (“Sponsor”), located at 134 NE 1st Avenue, Delray Beach FL 33444. Sponsor will conduct the Contest substantially as described in these Official Rules.
3. Agreement to Rules.
By entering this Contest, the Entrant (“You”) agrees to abide by the Sponsor's Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Contest you agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this 7taps Contest.
4. 7taps Contest Entry Period.
This promotion begins on February 6, 2024, at 10:00 AM Eastern Time and ends on March 31, 2024 at 11:59 PM Eastern Time (“Entry Period”). To be eligible for the Contest, entries must be received within the specified Entry Period.
5. How to Enter.
Eligible entrants can enter The 7taps Contest by following the steps described below:
Create an info bite (hereinafter called “Course”) using 7taps learning platform located at 7taps.com. The course can be created on any topic, except for illegal things, sexual context, and politics. You cannot violate anyone’s proprietary or intellectual property while you are creating the Course.
Submit the form at https://form.typeform.com/to/elMVHYsR. By submitting this form, You, the Entrant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
As a participant, your entry must fully meet all Contest requirements, as specified in the Official Rules, in order to be eligible to win the Prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor's sole discretion.
Disclosure in Connection with Publicizing Entry. If you choose to promote your entry via social media or other channels, you should disclose your connection to the 7taps Contest. For example, it may be sufficient to include the hashtag #7taps.
6. The Winner.
The winner of the 7taps Contest (the “Winner”) will receive an Apple Vision Pro, with 512 GB storage, retail value of $3699 (the Prize) based on the voting results. Sponsor might decide to include the ZEISS Optical Inserts, retail value $149, in the package.
Sponsor is not affiliated with Apple Inc. or ZEISS and does not commit to any specific date of the device delivery. Sponsor agrees to purchase the device and pay for the delivery costs within the US or provide Apple Gift Cards of the above-mentioned value to the winner. The delivery date or the device and its availability depends on Apple.com. The Winner will need to share the personal data required for the purchase and delivery of the Prize or purchase the prize using the Apple Gift cards provided by the Sponsor within a week of its receipt.
Other participants residing in the US will receive a pair of 7taps Socks, retail value $24. The actual/appraised Prize value may differ at the time the Prize is awarded.
The Prize(s) shall be determined solely by the Sponsor. There shall be no cash or other Prize substitution permitted except at the Sponsor’s discretion.
The Prize shall be purchased and delivered within the US unless the Sponsor decides otherwise.
The Prize is non-transferable.
If the Sponsor provides the Winner with Apple Gift Cards, the Winner must use those cards to buy Apple Vision Pro, with 512 GB storage. The purchase should be made within a week of the Gift Card receipt. Otherwise, the Winner violates these Terms and will be subject to Legal consequences.
The Winner, upon acceptance of the Prize, is solely responsible for all expenses related to the Prize, including without limitation any and all local, state, and federal taxes.
The Winner shall not transfer the assignment of the Prize to others nor shall the Winner request the cash equivalent or Prize substitution.
By accepting the Prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.
7. Selection and Notification of Winner.
The Winner will be selected in two steps.
Step 1: Sponsor selects 4 Entrants out of those who submitted the Course during the Entry Period. The selection is based on the Sponsor’s own judgment. Also, the courses should meet these criteria: Any resources used in the course are reliable and backed by facts or data. The language in a course is respectful and appropriate. The course must be original work and not violate anyone’s proprietary or intellectual property rights.
Step 2: On April 2nd, 2024 Sponsor includes 4 Entrants who were selected in Step 1 into a vote on the 7taps LinkedIn Profile located at https://www.linkedin.com/company/7tapshq. The voting will last for one week, until April 9, 2024. The voting is open only for LinkedIn users. Use of bots, macros, scripts, or other technical means of getting votes on Linkedin is forbidden and will result in disqualification from the contest and may be a violation of criminal and civil laws.
The Prize goes to the Entrant who gets the most votes by the end of the Voting Period.
The Prize will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
The Sponsor will notify the Winner(s) by email within ten days following the Winner's selection. The Sponsor is not responsible for nor shall have any liability for Winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall be Sponsor be liable for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the Prize within 30 days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the Prize may be forfeited and an alternate Winner may be selected. Receipt of the Prize offered in the 7taps Contest by the Winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES WILL BE IMMEDIATELY TERMINATED.
8. Rights Granted by You.
By submitting a Course to this Contest, You understand and agree that if you win the Contest, then the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees' successors, and assigns of the Sponsor, and users of 7taps learning management system, shall, where permitted by law, have the right to use this Course within 7taps platform, host it in 7taps free library of courses, share it, change or modify, distribute, broadcast and use in any media.
By accepting the prize, you allow the Sponsor to use your data for purchasing the Prize and delivery services.
The Course submitted to the contest must be original work and not violate anyone’s proprietary or intellectual property rights. The consequences for entries that infringe upon the intellectual property rights of others are the disqualification of the participant and any claims that arise as a result of the infringement. You shall defend or settle against such claims at your sole expense, and You shall indemnify, defend, and hold harmless the Sponsor from any suit, etc.
9. Terms & Conditions.
In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the 7taps Contest should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the 7taps Contest. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Contest or website or violate these Terms & Conditions will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the 7taps Contest, to void votes for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for voting and getting Likes on Linkedin. Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the 7taps Contest may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability.
Your entry into this Contest constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Contest and/or the 1) Winner accepting, possessing, using, or misusing of any awarded Prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.
11. Disputes.
THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. The Entrant agrees, as a condition of participating in this promotion, that if any disputes cannot be resolved between the Entrant and the Sponsor, and if causes of action arise out of or are connected with this Contest, they shall be individually resolved exclusively before a court located in Florida having jurisdiction, without resorting to any form of class action. Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). The participant waives all rights to have damages multiplied or increased.
